Canada's Anti-Spam Legislation and What It Means for the Construction Industry

Canada's Anti-Spam legislation (CASL) establishes new rules governing the sending of an electronic message for commercial purposes (CEM).

CASL takes effect on July 1, 2014 and applies to both individuals and organizations. After that date any CEM, such as an email or other electronic message containing advertisements, information about products or services, business opportunities or events, requires consent from the recipient before sending the message. Although there are circumstances where exceptions apply or implied consent may be relied on to satisfy this requirement, obtaining express consent after July 1, 2014 will be a challenge for most organizations. This is because a request for consent sent electronically is itself considered to be a CEM, which would require prior consent before it can be sent.

CASL also imposes content requirements for a CEM. After July 1, 2014, a CEM must include contact information for the sender and provide the recipient with a means to unsubscribe from receiving future CEMs.

Non-compliance with CASL may lead to significant enforcement penalties against an individual or organization. As the sender of the CEM has the onus of proving compliance, be sure your organization is ready for CASL before July 1, 2014.
